- Plot owners shall not allow interments to be made in their plots for remuneration; nor shall any transfer or assignment of any plot or any interest therein be valid without the written consent of the Tongore Cemetery Association. Under New York State law, no transfer or assignment may be made after an interment has been made.
- After the death and interment of the plot owner, no interments or use of the plot may be made until an affidavit of heirship is filed with the Tongore Cemetery Association.
- Written authorization is required from the plot owner or a legal representative to open a grave. All interments must be performed by the cemetery.
- The Tongore Cemetery Association assumes no responsibility for errors in accepting orders over the telephone.
- Disinterments may be made only with the consent of the Tongore Cemetery Association and the written consent of the plot owner(s), of the plot, and of the surviving spouse, children of full age, and parents of the deceased. If consent of any such person cannot be obtained or if the Tongore Cemetery Association refuses its consent, the consent of the Supreme Court of Ulster County will suffice. Disinterments must be made by the Tongore Cemetery Association.
- All plot enclosures of any description are prohibited. The placing of boxes, shells, toys, bricks, fencing or similar decorations on the grave or plot is not permitted, and if so placed, will be removed by the Tongore Cemetery Association. Flower holders must be metal. Glass or china containers are prohibited and shall be removed.
- No planting of any kind shall be made without written approval from the Tongore Cemetery Association. Unauthorized plantings may be removed without notice.
- Grave mounds are not permitted.
- If trees or shrubs situated on any plot shall become detrimental to or encroach upon adjacent plots, avenues or paths or become unsightly, the Tongore Cemetery Association, after due notice to the lot owner, shall have the right to enter said plot and remove said trees or shrubs or such parts thereof as they shall determine to be detrimental or unsightly. No tree growing within the plot or border shall be cut down or destroyed without the consent of the Tongore Cemetery Association.
- The owner of a plot shall have the right to erect any proper memorial, monument, or sepulchral. This work must be conducted by a professional according to the rules and regulations of the cemetery.
- Iron, wood, or artificial stone benches shall not be placed on any lot without permission. Watering cans and other items left on a plot may be removed by the Tongore Cemetery Association.
- The Tongore Cemetery Association may remove any offensive or improper objects or inscriptions. Costs will be charged to the lot owner.
- Trustees may amend rules and maintain roads and paths.
- “For Sale” signs are prohibited. Trucks are not allowed on Sundays or holidays.
- Families may visit during designated daylight hours. Children under 16 must be accompanied by an adult. Bicycles are prohibited.
- All steps and stoops erected upon a plot must be made from a single stone. Artificial stone or concrete is not permitted.
- No metallic items are allowed except:
– Galvanized or approved flower holders
– One metal flag holder per grave
– Bronze statuary on approved stone pedestals - All work in connection with interments, foundations, and care of plots is done by the Tongore Cemetery Association under the direction of the Superintendent at a time and in a manner specific to them.
Section 6
The General Rules and Regulations for Sections 1–5 also apply to Section 6. Additional rules:
- Plots will be sold in a minimum of two (2), each measuring 8 ft x 10 ft.
- Four (4) cornerstones with alphabetical letters must be placed at each corner of the plot. These grave markers shall be sold and placed by the Tongore Cemetery Association at the current cost and will include the labor for placement.
- Concrete vaults or grave liners are required for all graves purchased on or after Jan 1, 1985, per New York Cemetery Board Directive 202.6 (except cremations).
- For a two-plot designation, the maximum width of a monument is 48 inches.
- Only flush ground-level veteran’s or foot markers are permitted, installed under the Superintendent’s direction.
